Hypo: Donald Trump “determines” that an American citizen is a member of Aragua de Tren and DHS officials show up to deport him to El Salvador. Don't look for Judge Boasberg to lower the boom in this hearing. He is going to insist on info that they have no right to prevent his havin --even if they claim it is national security-- and will then get to bottom of the apparent noncompliance. he's already ordered gov to supply more info by morn.

Maybe the most insulting thing about the government's argument is that they are arguing they can't provide details because of national security but THEY MADE PROPAGANDA VIDEOS ABOUT EXACTLY WHAT HAPPENED.
With that, the hearing is over. The government will file more information tomorrow, which may again refuse to provide specific the information he requested (but at least explain why). There is a further hearing on the TRO on Friday, and action in the DC Circuit Court where briefing ends Wednesday.

Two things the Administration is saying they have UNREVIEWABLE authority to determine: 1) whether the deported prisoners were in fact members of the transnational crime group (their lawyers say some weren't); & 2) whether the group's actions in the US were "predatory incursions by a foreign govt."

Hearing ends with Boasberg repeating order to give him info by noon tomorrow. and says tartly "I will reduce all of this to writing b/c apparently my written orders don't carry much weight."
and focus also on third flight, which took off AFTER written order.

This idea that the Admin is trying to sell that they don't have to respond to, much less be bound by, an individual district court judge is particularly pernicious. We have 3 levels of federal courts. The orders of all of them are equally binding. If you don't like decisions, you can appeal.

Shorn of the legalities, the Admin basic position is that we can do whatever we want if we say it's national security (and that includes Trump lies about same, which can't be questioned) and we don't have to tell court or anyone why.

That's tyranny, plain and simple.
