Wow. Genuinely shocked, and a hugely consequential decision.

Importantly, this is a case where @martylederman.bsky.social's amicus brief appears to have made a MAJOR impact. Before he wrote it, courts were sidestepping the "regular forces" issue entirely. And that's what the Trump admin lost on.

ABA therapy is extremely controversial but one of the reasons these families are so terrified of losing it is ABA centers will provide up to 40 hours of therapy a week. Many of these kids have behaviors that disqualify them from daycare, so ABA placements are the only option for parents with jobs.

There’s a lesson here about writing in the age of weaponized lies: Always precede false claims with giant red text, ideally wrapped in a <blink> tag, that says “THIS IS A LIE I AM REFUTING!!”

But also, why is a book that makes this kind of lazy, bad-faith argumentation getting any accolades at all?
