Yesterday brought news that country star Zach Bryan is dropping a song critical of ICE.

Today, the official DHS account trolls him by using one of his songs (without permission, one strongly presumes) over the kind of cinematic footage Trump loves, of masked federal agents clashing with Americans.

Side note, I think it's funny how "Temu" has become a colloquial derogatory term for fakes. It used to be "astroturf", so much that people forgot that Astroturf is a trademark. I don't know what Temu is doing about this.

In this opinion, the court allows Temu's DMCA misrepresentation claims to proceed.

Temu alleges that Shein falsely claims ownership in the works, inundates Temu with tens of thousands of DMCA claims, and refuses to provide proof of ownership on request.

In its motion to dismiss, Shein argued that Temu hasn't alleged that it "knowingly" misrepresented copyright infringement. But that was easily taken care of in Temu's complaint.

Apparently in the first nine months of 2025 the US Copyright Office registered over 3,000 works which list AI content in material which is in the work but excluded from the claim. This is the standard practice now. The vast majority were text but hundreds in music as well.

Unanimous First Circuit takes pains to emphasize that this was an incredibly easy case to decide, despite writing a very long opinion knocking down every ridiculous argument the Trump admin made.
The analysis that follows is necessarily lengthy, as we
must address the parties' numerous arguments in each of the cases
involved. But the length of our analysis should not be mistaken
for a sign that the fundamental question that these cases raise

But keep in mind this isn't a ruling that the album is a trade secret, only that the plaintiff can move forward with the claim and prove that it is. 5/5
