The interests of suspects in not having a confession beaten out of them is ultimately an interest in evading the law, which is not an especially weighty interest.
I’m still trying to wrap my mind around Kavanaugh actually writing this, as if the Fourth Amendment only protects people who have not done anything illegal. This is so foundationally wrong that it’s hard to know where to start.
