Feminist Responses to the Regression of Trans Rights: Strategies, Alliances, Hope

Amidst continuing backlash against trans rights, recognition and inclusion, two recent decisions from the UK have substantially impacted not only trans people’s legal status but also legal and social narratives of sex, gender and identity. The narrative that trans inclusion has a chilling effect on the rights of others, particularly women, has been adopted uncritically by both the UK Supreme Court in For Women Scotland and the Office for Students in its finding that the University of Sussex’s trans-inclusion policy had a chilling effect on free speech. These cases highlight a backlash that has been ongoing for some time, and sparks debates and fear of what may lie in the near future for trans people and kin, as well as other gender-variant persons, not only in the UK, but across jurisdictions and in a global perspective. The discourse of the ‘gender critical’ movement is splintering both the feminist and LGBT+ movements globally, with some aligning politically with the Far- and Christian Right against trans rights, adopting their terminology of ‘gender ideology’ and potentially posing a wider threat to sexual and reproductive rights.  

While this a difficult situation for trans people, kin and allies, this special issue seeks to emphasise that legal battles – including battles (temporarily) lost – are also an opportunity to seek to reinforce old alliances and to form new ones, to find new legal frontiers and imaginaries, to reinforce the theoretical and methodological underpinnings of legal arguments as well as intergenerational memory of what feminist legal work is, has been and should be about. How, we ask, do these decisions (and those like them globally) reflect and reproduce structures of coloniality, heteronormativity and cisnormativity? What do these decisions add to critiques of legal feminism? What would be construct…

I’ve signed this letter calling for full parliamentary scrutiny of the EHRC’s guidance.

Trans people deserve clarity, dignity, and safe access to services - not uncertainty and exclusion. Parliament must ensure that any guidance reflects lived experience and protects everyone’s rights.

Our friends at TACC have discovered yet more evidence of shocking EHRC cover-up. An FOI request reveals that the EHRC is not planning to publish a report on its public consultation until AFTER its new Code of Practice has gone all the way through Parliament, and is a “done deal”.

When the new Code is laid in Parliament, MPs will have 40 days to carefully scrutinise and evaluate it. But how can they carry out this important Parliamentary duty without any insight into the public’s 50,000+ submissions to the EHRC’s obligatory consultation? MPs will have no idea whether the EHRC integrated any of those stakeholder responses into its finalised Code – or ignored them entirely.

Luckily, TransActual and TACC anticipated exactly this problem. They asked individuals and organisations to share their EHRC public consultation submissions with them.

The result was a massive 10-volume dossier, which we have delivered directly to the heart of Government.

Any MP who genuinely wants to know the questions, fears and concerns the public have raised about the EHRC’s new Code doesn’t need to sit in the dark while the EHRC conceals its report until it is too late.

They simply need to go to the offices of Equalities Ministers Bridget Phillipson and Nia Griffith, and ask to read the completely uncensored submissions already in their possession.

To Women & Equalities Committee
We, the undersigned, write to express serious and urgent concerns about the actions of the Equality and Human Rights Commission (EHRC) and the apparent unwillingness of the Women and Equalities Committee (WEC) to investigate them.

It is becoming increasingly clear that the EHRC is no longer operating as an impartial human rights body. Over the past several years, its leadership has shifted in a direction that appears ideologically driven, hostile to trans equality, and closely aligned with lobbying groups who advocate for the removal of legal protections for transgender people. These groups - including Sex Matters, Policy Exchange, and the LGB Alliance - have played a significant role in reshaping public discourse and influencing legal interpretations of the Equality Act 2010.

We are calling on the Women and Equalities Committee to launch an immediate and transparent inquiry into:

- The EHRC’s internal decision-making processes regarding the definition of “sex” under the Equality Act 2010;

- All communications, meetings, and correspondence between the EHRC and external lobbying organisations from 2020 to the present;

- The EHRC’s advice to government departments, ministers, and the courts—especially its role in shaping the outcome of For Women Scotland v The Lord Advocate [2024] UKSC 59.

As transgender people and allies, we are gravely concerned that this advice, and the EHRC’s developing policy stance have been influenced not by human rights or evidence, but by ideological lobbying and political convenience. We must understand who the EHRC has been speaking to, what was said, and why these decisions were made. Anything less is a dereliction of democratic oversight.
