We now believe we can arguably plead the ‘CPS Code for Prosecutors’ makes decisions not to charge predictably more likely, significantly so, in communications offences directed at trans people, *even where* the legal thresholds are met!

The CPS, Police & Judiciary have, undeniably, blocked justice for our community for years now. It’s taking a long time to complete, so we hope we finally see a sign of change.

This is Alice Sullivan’s Letter Before Action.

42 pages no less, but Alice is an ‘intellectual’ and merits 42 pages. The solicitors are well known anti-trans Christian evangelicals.

It’s interesting how often TERFs claim they don’t give consent to trans women using a toilet. They don’t require consent from others to enter. It’s a public facility. I don’t have to give consent to anyone entering the gents toilets when I am already in there or ask for it to enter.

The limited evidence consists of the Cass Report and nothing else. And in the UK this “possible unknown harm”, despite statutory wording and EU law that point in the opposite direction, was used to justify the emergency ban.

I've had some, limited, experience with employment tribunal judgments and judges working under considerable time pressure to write lengthy and detailed judgments often make clumsy errors of spelling, transcription and so on. That's axiomatically more likely true in the case of 300+ page judgments.

Parliament explicitly protected the rights of trans people; but the notion the rights of transphobes are protected is judge made law. And I think its wrong. We will certainly look for an opportunity to take eg the point that racists don't enjoy the same Equality Act protections as people of colour.
