I think the immigration judge deciding his case has a very real voice in the back of their head saying that if they rule against the admin, they'll be fired.
Mahmoud Khalil lost his bid for a waiver of removability, making him one step closer to deportation.

He claims his immigration judge took Marco Rubio's "misrepresentations" about him as gospel, and is asking a NJ judge to step in.

Here's some of the immigration judge's ruling:

Oh man Eric Boehlert is sorely missed in this media environment. 🥺
Quite literally, the scandal was "The entire Reagan administration decided Congress didn't matter & the President/executive branch could just do the illegal things anyway," & the lesson learned by GWB & now Trump was very clear. We're here, now, on the brink of authoritarianism, because of this.

IMHO specifically this has its roots in 1996.

Congress passed a law that got rid of a lot of the ways for people to go from unauthorized to legal, and left executive discretion as the remaining lever for dovish policy.

No surprise we’ve spent the last 30 years fighting over that lever.
I’ve thought about this (and years ago thought maybe I could do it) but I’ve concluded that it’s fundamentally not possible to be a liberal Stephen Miller on immigration. The laws/judiciary are too systematically biased against pro-immigrant policy and as we saw under Biden, the backlash too strong.
I will note something I keep hearing from different lawyers, immigration activists, Dem operatives et al:

There is no Democratic Stephen miller . And that’s a problem
