Two exceedingly interesting articles from Sai Prakash (U.Va. Law) on founding-era legal interpretation. In the first, he argues that "the Founders were not textualists," frequently elevating the "spirit" of the law above its letter in ways modern textualists resist. /1

The Founders were not textualists. Certainly, the letter of the law mattered quite a bit. But, as William Blackstone noted, interpretation also required the con

As one of the countless people *actually* cancelled by Bari Weiss, via her vast favor-trading networks of fellow nepotistic gatekeepers in media and publishing, I think both of these asinine dipshits should go fuck themselves.
Matt Yglesias QT'ing Corey Walker

I didn’t rejoice at her cancellation and got cancelled myself at roughly the same time, but I am sincerely jealous that no regime-aligned billionaire has even fit to curry favor with the Trump administration by giving me a huge sum of money.

The vitriol against Bari Weiss is just thinly-veiled jealousy by people who rejoiced at "cancelling" her in 2020 and are furious she managed to get fabulously wealthy in an infamously brutal and low-paying industry.

I'm not a fan of tariffs, but if you are going to do them, this is an appropriate way under WTO rules.

The proposed measure is fully WTO compliant. Upon receipt of a mandate from the Council, the EU will swiftly engage with affected EU trading partners under the Article XXVIII GATT procedure regarding this change to the EU's WTO tariffs, with a view to offering them country specific allocations.

Thanks! It looks like the pitcher heads out to 2nd. Not sure how it all would have played out.

Great breakdown here by Jimmy Rollins.

Thomson says the Dodgers “did a great job disguising the wheel play.” But they showed it on the previous pitch and Stott said he knew the wheel play was on. Unclear if Castellanos knew.

Looks to me like Casty can make it back to 2nd there after the throw is made.

I'm curious if there is footage of what everyone actually did here.

What was the 2nd baseman doing? If he's not covering 2nd, if I'm Casty, I fake going to 3rd to draw the throw, then go back to 2nd.

Prime Minister Mark Carney of Canada will have his second White House meeting with President Trump on Tuesday. Carney is seeking relief from U.S. tariffs, but few people expect any major concessions.

With regard to Weiss saying "America is good" and "the West is good," I wish someone would ask her to elaborate on who exactly she thinks is bad and why. (I can guess, of course, but still would be helpful to force her to articulate it)

There’s a lot in Bari Weiss’ 2023 FedSoc speech that merits scrutiny but I think the Times did a disservice by closing with this quote — given what she says immediately after. fedsoc.org/commentary/f...
