the biggest problem of people wanting an alternative to discord is gonna be the actual moving part, just like with twitter, a 1 to 1 open source recreation could appear online randomly and no one would move to that shit just because "all my friends are still on discord", nothing ever happens

Odds are this aggressively did not happen. But it would of course be just as unconstitutional to spend money donated to the government without a duly enacted appropriation as it is to spend tax money that way.
