If you are a normal person, it's easy to say that Trump could be criminally prosecuted for using the military to kill his political opponents. If you are a Trump judicial nominee, the calculus is apparently more complicated.

By a vote of 50-47, the #Senate confirmed Jennifer Lee Mascott to be US Circuit Judge for the Third Circuit.

GOP Sen. Murkowski voted against and Sens. Cortez Masto, Cotton, and Cruz did not vote.

The Judiciary Committee advanced five judicial nominees today, including Seventh Circuit nominee Rebecca Taibleson. For some reason, two Mississippi nominees (Chamberlin & Maxwell) have been held over several times, including today.

On Thursday, the Senate Judiciary Committee will vote out the last of Trump's judicial nominees (except John Guard, whose nomination is stalled because of his potential involvement in some Medicare scam). Realistically, there's probably only time for one more group of nominees to get through.

Right from the start Judge Graber says she has questions for both counsels:

(1) What document authorizes the action? Is it the President's memo?

McArthur: cites the June memo, Trump's Truth Social post (!!), and a DHS memo, and "further posts on social media" in October.

Iowa’s brief is signed, of course, by the state’s 33-year old Solicitor General (who clerked for Judge Jim Ho). The responsibility for a state’s partisan dirty work is increasing falling on state SGs (which is why Trump is putting so many of them on the bench).

We've got great people working on it. Fantastic people. They're saying, 'Sir, this is a fungus, not a virus, and I said,
'Well, a lot of people are saying it's sort of both, isn't it?' You know, it's, it's in the air, it's in the brain — very sad. Very sad! And, by the way, we're sending in the National Guard, they're doing an incredible job, the best job. People are saying they haven't seen anything like it since the, uh, Walking Dead, which was a show, a very good show, actually. A lot of people liked that show. Not as good as The Apprentice, but very popular."

Trump:
"Totally under control. Under tremendous control.
We've got, what, two, maybe three cities — small ones, not big — where people, they've got mushrooms coming out of their heads, which is, you know, it's not ideal. Not ideal! But it's getting better.
A lot of people don't know, fungus doesn't like sunlight. I've always said that — you get a lot of sun, you don't get the fungus. Florida, doing great.
Beautiful place, very low infection. Terrific governor down there, by the way, he's been calling me — he says, 'Sir, we've got people growing mushrooms in Massachusetts, and I said, 'That's what they do, that's Massachusetts for you' So we're watching it closely."

Reporter: Some people are calling for federal evacuation centers—
Trump:
"We're looking at that. We're looking very strongly at that. We've got FEMA, we've got the CDC, we've got... uh... a lot of C's, a lot of very smart people with letters in their names. They're doing fantastic things.
And we're gonna have beautiful centers, if we need them. Not like those old ones — these will be tremendous. Five-star shelters. You'll have food, you'll have water, you'll have air — very clean air. The best air. Maybe even golf, who knows? We're working on that. People need recreation. You can't just sit around worrying about spores all day. You gotta enjoy yourself!"
