Hard to imagine a more structurally insane result on separation of powers that SecDef, on nothing more than his own say-so under 688, can take a member of Congress who happens to be a retired officer, involuntarily recall them, and thereby disqualify them from Congress.

It's all so insane I don't expect it to even get this far, they're doing a performative sham 'investigation.' But I think Kelly would have a decent as-applied challenge that it's unconstitutional for 688 to be used by the administration to create a disqualification for a sitting member of Congress.

In the 2010s Labour MPs stood up to Corbyn, and Tory MPs stood against an ultra-hard Brexit, even to the point of dozens losing or resigning their whips and caucusing independently. Compare to 8 years of cowardly GOP Reps believing that their only options are to bow to Trump or quit the House.
