Yeah, I'm realising a lot in hindsight. In the past, I thought some judges were relying on EU law to circumvent limitations on their ability to be supportive of trans people. Sadly, it seems that most of them were begrudgingly deferring and pounced on the chance to return to historical viciousness

Oh I absolutely agree about the vast majority of judgments. In my teens, I naively hoped that A v CC of West Yorkshire (2004) might signal a trend towards improvement, but they've continued to be absolutely vile and seem to have become even worse now that EU law isn't shielding us

It's so vile. I've always been of the opinion that active deception should obviously matter in cases that have serious physical consequence (e.g. pregnancy) or when it involves abuse of State power (e.g. undercover cops), among others. The British judiciary has found ways to permit both of those :/

The judiciary has created such a mess that enables abusive men and criminalises Other-ness. I can't begin to comprehend how actively lying about a vasectomy (and causing pregnancy) isn't proximate enough to the sex act to vitiate consent while giving a blowjob as a trans woman ~is~ sufficient

People will try to differentiate today's conviction by pointing to the fact that the trans woman actively claimed to be on her period. But if you look at the language used by the judge, CPS, and police, I think it's clear that they have haven't constrained their definition of 'deception' to that act

In the early 2010s, I worried that R v McNally would eventually lead to trans people being prosecuted for sexual assault based on the idea that our presentation is inherently 'deceptive'. I let myself be convinced otherwise by people that had criminal law expertise. I think I was wrong to listen

Predictably, the UK judiciary finds ways to enable the abuse of men (e.g. lying to women as an undercover cop) while ruining the lives of people that deviate from cishet expectations

Our courts also allowed the appeal of a man that lied about a non-existent vasectomy to deceive multiple victims, including causing one to need a termination. One of the most obvious forms of sexual abuse was just a 'quality' that didn't vitiate consent (R v Lawrance (2020))

It really is so great. The cynical, vigilant worrier in me is always a little concerned that it might fade like other feelings but this one never does. It does the opposite and that's so magical to me, as basic and obvious as I'm sure it is to other people

The YP factionalism and sexism is awful (and predictable) but everyone involved has consistently been incompetent, egotistical, tactically useless, and Labour-brained. Bluntly, she's a liability
