Because i've been asked, my hot take is that wildfire liability discussions in CA that don't lead to full state ownership & control of the electrical corps will saddle the public sector with cleaning up damages the private sector is more than happy to continue to 'externalize'.

If you ask Californians to fund wildfire adaptation and there's no appreciable reduction in the payments to the utilities everyone knows cause the wildfires *at the same exact time*, it looks like we're all being asked to pay twice - once to start the fire, once to clean it up. Terrible politics.

a point I feel the need to make about regulation, generally: it’s not that companies will automatically follow the law or that regulatory penalties can always be greater than the benefit of acting illegally

I used to think that originalism had some theoretical flaws that would make it hard to implement in reality. Now I realize that the flaw of originalism is that they just didn’t mean any of it and it’s all just cover for imposing their preferred partisan outcomes.
