Our current mental health system can't provide services as it is, and the courts will be unable to keep up with cases that it needs to adjudicate. The EO, as written, could potentially be used to institutionalize the homeless and mental illness without due process.

Judge in the lower federal courts are trying to play a role that are not used to, trying to wake up the public to what's going on, while remaining true to their constitutional role.
NEW: I analyzed nearly 300 federal cases involving the Trump administration. Federal judges—across the political spectrum—are using language I’ve never seen before. One called government actions “unconscionable.” Another quoted Kafka. They’re begging us to pay attention.
