Edit: This is a Preliminary Injunction, rather than a TRO. The judge converted the motion for TRO into a motion for a preliminary injunction.

For non-lawyers: a TRO is very temporary, followed by further proceedings on whether to convert it into a PI. A PI stays in effect until the final judgment.

The order prohibits retaliation, arrests without probable cause, the use of pepper spray or crowd-control weapons, and vehicle stops made without reasonable suspicion. It also makes clear that simply monitoring or following ICE from a safe distance does not justify a stop or detention.

A federal court had to weigh the detailed sworn testimony of at least 19 witnesses against the affidavit of an ICE official who didn’t personally witness anything & whose testimony conflicted with the videos. Injunction followed. The regime’s lies just can’t carry the day in court.

This is a preliminary injunction (not a Temporary Restraining Order) — it is very, very thorough and to my mind written to withstand appellate review.

We are relieved that in Tincher v. Noem et al. the court has issued a preliminary injunction. The ACLU-MN is hopeful that it will prevent further First Amendment violations like the ones that have been harming Minnesotans since the start of “Operation Metro Surge.”

Icky Stephen Miller is trying to lie his way into immunity for ICE. They don't have it. Don't believe him.
How is this not inciting violence?

Why must they remind ICE that they have immunity?

One of their agents just shot a killed a woman in broad daylight and they’re effectively telling them to go ahead and do whatever they want because they’re above the law.

Be safe Minneapolis.
