The U.S. is giving dying mall vibes.

I can't explain it, but you know I'm right.

7. The proposed rule nevertheless asserts that these guidelines would preempt state laws, placing a direct target on the “shield laws” enacted by states like California, Minnesota, and New York. The text is explicit in its intent to override state sovereignty.

6. The government attempts to get around this by stating that gender affirming care is not part of “the practice of medicine.” In a section dedicated to this anticipated challenge, the new rule states:

5. This rule violates multiple U.S. statutes and constitutional limits on federal authority. Most notably, Section 1801 of the Social Security Act explicitly bars the federal government from using Medicaid regulations to exercise direct supervision or control over the practice of medicine.

4.The new rule contains no exceptions for patients already receiving care, meaning transgender youth who have remained in treatment even under some red-state bans would immediately see that care cut off. For many, this would amount to forced medical detransition.

The government acknowledges this.

3. Rather than directly banning Medicaid reimbursement for transgender care, the rule would bar any hospital that accepts Medicaid funding from providing gender-affirming care for trans youth at all, regardless of whether that care is paid for by Medicaid.

2. On Thursday, the Trump administration’s HHS, under Secretary Robert F. Kennedy Jr., released a new rule that uses Medicaid "conditions of participation" to strip funding from hospitals that treat trans youth—the most aggressive attack on trans healthcare in U.S. history.

1. The federal government has just attempted to enact a national trans youth care ban.

A new HHS rule would shutter most gender-affirming care for trans youth nationwide.

It violates multiple laws and the constitution, and will likely go into effect in a few months.

Nationwide Trans Youth Care Ban Imminent As Trump Admin Announces "Nuclear Option" Federal Rule
The new federal rule formalizes previous threats to hospitals to pull Medicaid funding, and represents a significant legal stretch by this administration.

A second national anti-trans healthcare bill has passed the US House, a medicaid ban for trans youth. 4 Democrats crossed party lines to vote for it. Henry Cueller (TX), Vincente Gonzalez (TX), Don Davis (NC), and Marie Gluesenkamp Perez (WA). It is not expected to get through the Senate filibuster.

I spent a month in Uganda, where LGBT (especially T) is HIGHLY criminalized. Ppl most at risk when laws like the 2023 AHA (Anti Homosexuality Act) are those who’ve already started living openly, ESPECIALLY trans ppl who are transitioning, bc they are reliant on medication & thus open to extortion.

Parents of trans kids in the US: It’s not available to most of you, unfortunately, but if you have a roadmap open to your family to a better country, it’s probably time to pack up and go. Even if this bill doesn’t pass the Senate, the moral panic is just too hot and relentless in the US, sadly.
Just now, a national trans healthcare felony ban for youth has passed the US House, with 10 year prison terms.

3 Dems crossed party lines to vote to jail providers.

4 GOP crossed party lines to vote against.

It is not expected to pass the Senate, where Dems hold filibuster power.

Story to come.

7. As of late December, at least 20 major hospital systems have ended gender-affirming care for transgender youth. While a handful of providers have attempted to absorb displaced patients, many families have been left without appointments, continuity of care, or any clear path forward.
At least 21 hospitals have ended or restricted trans care for minors since January
The disruptions follow multiple efforts by the Trump administration to block such care for patients younger than 19.
