I find it even more interesting how the primacy of the question usually serves not as part of a call to engage our personal and collective responsibility to stop abuse, but rather as a way to avoid that responsibility entirely.

We now need to wait for the CJEU to publish the whole thing, so in the meantime, a good question: why so long? The Commission launched an infringement procedure in 2021 following the anti-EU law primacy judgment K 3/21. Only at that point, Berlaymont decided that it had a sure footing to act. 2/

I think an important key is the general tendency to provincial primacy over municipalities vs. home rule in municipalities and counties. It's weaker in Alberta but I think pre-emptive annexation by Edmonton and Calgary of their fringes basically shut out the leapfrogging common in USA.

In addition to legislation, we would also need amendments that restrict a future president's abilities in ways that he has exploited. That would include pardons, removal of "national security" as an all-purpose bypass code, tariff control, and de facto overrides of congress's primacy in budgeting.
