Before COVID, there was an unstated sense of collective responsibility that has since shattered.

All the "fuck you I got mine" ppl made massive gains since then, and even ppl against them learned to ignore disabled folks who are STILL vulnerable even with vaccines available.

Massive escalation at the Portland ICE facility. Worst I’ve ever seen. More pepper balls than I can count. Teargas in the middle of crowd. Violent arrests. Some type of either noise or rubber bullet shotgun fired into the air then later aimed at protesters chests/heads at near point blank range.

But we're actually on the proverbial slippery slope: With each Guard deployment gambit, Trump (Miller) pushes the legal envelope: DC deployment was legal because, well, DC is isn't a state. LA federalization was legal because it's "only" protecting federal facilities and federal law enforcement. 4/x

While we wait for the 9th (and now 7th) Circuit to address the issue of guard deployment, I keep coming back to this. If Portland's "facts on the ground" are legally sufficient to deploy military on our streets, the days of whimsy as protest are over. Because why bother. 🧵 1/x

My initial read on this argument: Judge Nelson is eager to disagree with his 9th Cir. colleagues that federalizing the NG is reviewable at all.

He's also eager to disagree with Judge Immergut that the Portland protests were small and under control.

I want to add this, because if you haven't been in this situation, maybe you don't know. When a cop in riot gear is shoving you and yelling "GET BACK," there's usually nowhere to actually get back to, because there's a crowd of people behind you and you literally can't move at the pace they want.
