You must defer to the president’s determination that there is an armed rebellion in Chicago, argues the govt’s lawyer.

That’s the Trump admin’s stance on everything. When the law doesn’t allow it, lie about the facts until it’s something that would be legal, then insist others live inside the lie.

Well this is gross. If the panel rules in the DoJ's favor, what's the next step? Is that it, there's no recourse against the NG, or does the case proceed in some other form? Forgive my ignorance, trying to follow this and Illinois at the same time is giving me a headache

I think this would apply exclusively to the federal charges, not state. Though one assumes his attorneys will argue the administration's statements have irrevocably poisoned the jury pool.

In following the liveblogs it sure sounds like their position is that Trump can federalize the NG at any time, and send them anywhere, and his justification for doing so is unreviewable.

Hard to see how that isn't the death of states' rights.
