What does it mean to have a human in the loop of medical AI? Here's a fun place to look: a 2022 FDA guidance that's about what *doesn't* count as a medical device!
Had a blast exploring this quasi-standard, out in the Penn J of Law & Innovation: papers.ssrn.com/sol3/papers....

Have you read a good article recently? Been provoked or stimulated by another scholar's work? Did you gain new insights? Let them know! (Especially if they are someone you have not met or are outside your normal circles.)

What's going on in the world of dupes, & how do these rapid-fire copies interact with the law?

Fascinating @theverge.com piece with great quotes & analysis from two top experts: @lexlanham.bsky.social & @design-law.bsky.social

Genomic data: neat! But also super sensitive! How can people get their own genomes analyzed without sharing stuff they don't want to?
Jake Sherkow of Illinois Law presents a neat technical approach and argues that yep, patent law can enable it.
At Copenhagen Law at #ATRIP25 (in dramatic light!)
A nattily dressed scholar gestures to a slide of software schematics in a dramatically lit room.

OK for a moment I didn't clock that was a street outside and thought it was a coffeeshop-cum-waiting-area for dental surgery and was a little terrified.
But it looks great!

What court cases are reshaping FDA?

ACLA v FDA: FDA can't regulate lab-developed tests.
SEC v Jarkesy: Can FDA impose civil monetary penalties re: tobacco?
Corner Post: How many old FDA decisions can be challenged?

Two Harvard economists forecast the impact of the administration’s proposed NIH budget cuts- stunning losses in new therapies, life expectancy, and economic output with a “social cost 16 times greater than the savings the administration is attempting to achieve."

Really wish I could put this on a sign that I could tap.

There is no reason to make this situation worse than it already is by insisting that there’s nothing to be done because we are all under a dictatorship already. It is not true, and it is not helpful.

OK, a roundup response to the "they won't follow the court orders" people.

First of all, you're wrong! The administration *is* following many of the court orders.

What's more, they're showing their understanding of the validity of court orders by seeking stays pending appeal when they lose.

This this this:
The purpose of writing is not to put words on a page. It’s to discover *which* words need to be put on the page to accurately express the thing you’re trying to express.

This puts it well & it’s a point I keep making about why using AI to write is so flattening. Writing is the process of working out & refining what you think. If I write an article, I’m not just generating 1000 plausible words. I’m trying to articulate ideas with precision, & challenging myself.
jonlewis.bsky.social
AI is for people who don't want to or can't think. Period.

I write to figure out what I think and how to think about it better.
nicholson.bsky.social
I would love to read that, if you wouldn't mind sharing (a quick Google didn't find it for me)

This is woefully insufficient for what you need, but just in case it's useful, this is a bit I ginned up for my heavy-reading seminars.
I also point them to Paul Edward's 2000 How to Read a Book, available (among other places) here: www.cs.yorku.ca/~aboelaze/ho...
