Just FYI arresting a greencard holder for otherwise 1A-protected protest, overnighting him to a private detention facility in central Louisiana, & holding him w/o bond pending review of his status by an immigration judge can all be easily justified by law which has been in effect for 20 years

The distinction being that there is a law on the books that empowers the detention. But the law maybe over-broad to the point that the law shouldn’t exist as it is, thus making it unconstitutional. They are allowed to do the thing but shouldn’t be.
