As the Supreme Court term begins, keep this framework in mind: Autocratic Legalism.

Instead of “rule of law” (law constrains the power), we get “rule by law” (law as a weapon for power).

Authoritarians usually have to install allies. Trump started his second term with that step already complete.
The only effective opposition is through the language of morality and documented harm—not legal technicalities that can be swept away with a 6–3 vote.” The text is centered on a neutral background, with “morality” and “documented harm” slightly emphasized to underscore the moral and empirical contrast with “legal technicalities.”

An immigration court case to watch:

Federal agents illegally arrested nearly 2 dozen people earlier this year without warrants in violation of a 2022 consent decree, a federal judge in Chicago ruled late Tuesday.

Trump fired a bunch of Immigration Judges + Board of Immigration Appeals members so that he could stack those orgs with loyalists. Our NSF funded research confirms the work background of IJs and BIA members predict their rate of asylum denial. See also our description of the immigration bureaucracy.

I don't really get the CPS decision in the China spying prosecution, any more than Mark Elliot does publiclawforeveryone.com/2025/10/08/o... or the lawyers quoted in the Guardian: www.theguardian.com/law/2025/oct.... My *guess* is that it must have been a complex tangle of evidential worries.

if monroe doesn't like that fact, there might be little she can do about it under current law:

I think of myself as a criminal legal system minimalist. So yes, I agree with this. We use prison too much and for too long, and yet I still agree with this.

Good Lord, a lawyer? Acting in their clients' best interests no matter who the clients are? What a story 😱

Jokes aside, tarring lawyers with the characteristics of their clients has a dark history in Ireland.

An absurd and outrageous response. Prosecutors shouldn’t bring cases until they’re ready to try them, they are the ones that decide when it happens, constrained only by the statute of limitations, if they can’t get their hands around the evidence before that time, tough.
annabower.bsky.social
At one point during the hearing, the judge asked the prosecution why the case can’t be tried before mid-December.

Lemons replied: We are “just getting our hands around” discovery in the case.

There’s lots of it, he added, and it includes a “significant” amount of classified information.
