Question for lawyer types: the 25th Amendment says when there is a vacancy in the vice presidency, the President *shall* nominate someone to be confirmed. Two questions: 1) if they didn’t, there’s no consequence, right? 2) If it was an *acting* president, does the “shall” still function?

So if you get a justice who dies or retires with five years left to go, then obviously you need a replacement, but the replacement would only serve that same remaining five years, same as somebody filling a vacancy in Congress. It doesn't reset the term, you only finish the unexpired part of it.
