I'm not sure where this idea comes from that ICE and Border Patrol couldn't hack it in the "real" military. The data does not support this; in fact both of these agencies recruit heavily from the military. A very large number of Border Patrol agents and Deportation Officers are former infantry.

Anyone who hangs around certain boy hobbies--martial arts, video games, RPGs, comics--knows a bunch of short-timers, many of whom think about or actually do rejoin some branch of the military because without someone shouting at them to get up early, they end up stuck on their couches eating nachos.
The more accurate observation for ICE and Border Patrol is not that they're military wannabes who couldn't hack it in the service, it's that they're military short-timers.
Usually guys with low ambition and drive who didn't advance, and with an MOS that doesn't prepare them well for civilian jobs.
