The Office of Management and Budget sent a notification to Congress about their intent to use research and development funds to pay members of the military, two sources with direct knowledge tell NBC News.

A spokesperson for the OMB confirmed to NBC News that it plans to use the research and development funds and that there are two years' worth of funds available within the Department of Defense.

Because of how complex defense accounting is and how the money crosses different years and programs, DFAS is set up specifically to draw at those dates from those programs. You can't just create $15b dollars, you need to allocate it across a bunch of different areas and subsequently pull from/

Appropriations are laws. It is illegal to move money in this way and whichever DOD staffer makes/approves/facilitates this transfer of funds is breaking the law. On a state level, if a state employee did this they would face criminal penalties and possibly *personal* liability for the funds
