Democrats are doing this from a position of *strength*. What would be the point of voting to give them a majority if this is how they use power.
Trump is as weak as he's ever been while in office, and as the political losses continue to mount in the coming weeks (they will!), that will present an Republicans in Congress with political space to start forcefully pushing back. It will be very revealing if they actually take that step.

He's leaving the bench so that he can speak out against matters that many others are also speaking out against, and as a result he is creating a vacancy for Trump to fill.

There might be a cost-benefit analysis problem here?
