This case is about a woman who performed oral sex on a man. First, whether she’s trans will never be relevant to any sex act, and second, whether she had a penis or not is irrelevant to what they were doing which didn’t involve her genitalia in any way, shape, or form.

And requiring marginalised people to disclose our status each time under the threat of being sent to prison is particularly pernicious. It can be dangerous to let people know you’re trans, and yet the law expects you to do it under the threat of being branded a rapist. This is genocidal.

That’s what’s insidious here IMO. Deception can absolutely be used to make somebody have sex with you in a way which makes the whole thing completely non-consensual but the way this law works, it just punishes trans and gender non-conforming people instead. Medical *history* is irrelevant to sex.

If you lie about having had vasectomy, or that you’ll use a condom? Or even about identity IMO. A theoretical possibility that’s pretty out there but let’s say you have two identical twins and one of them pretends to be the other in order to get sex from somebody else. There’s no valid consent here.

IMO in some cases a deception *can* vitiate consent, but that’s like… first and foremost intentional—you *know* that the other person wouldn’t agree if they were informed and therefore you create a deception in order to *make* them agree. And it’s about something relevant to the sex act in question.

Can't wait for the UK to invent the charge "impersonating a heterosexual/homosexual" to criminalize cis straight & gay people being happily in relationships with trans people. Bisexuality, of course, will be illegal outright under new sumptuary laws for being extravagant under austerity conditions

I wrote an article in January about where we have ended up in English law re. "deception as to sex", and what that means for trans people. I think it's likely we can expect to see more of these sorts of cases going forward.

The judge is basically saying that every time a trans woman has sex with a straight man, it’s rape by deceit. It’s more than clear what’s being done here and it’s criminalising our mere existence.

Not exaggerating btw. If a trans woman lying about being trans is rape, and *by definition* deception is the only way a straight man would ever have sex with her, than all consensual sex between het men and trans women is by definition rape.

Note that "frustration at wanting sexual experiences with heterosexual males", "by definition", and "deceive to achieve" are in quotation marks, indicating that they are the judge's exact words, not the BBC summarizing or paraphrasing them.

Other forms of sexual assault (not by penetration) are in the third category. It doesn’t matter what’s the gender of a victim, the only things which matter are if the offender committed penetration and if yes, if it was committed with a penis. This is very bad but in no way is it legal to rape men.

Correction because I was incensed while replying to this, as it’s a very common TERF talking point: English law draws a patriarchal distinction between different forms of sexual assault. Only penetration with a penis qualifies as ‘rape’. Penetration with anything else carries the same penalty.

The thing is, she simply didn’t disclose that she’s trans and that’s enough under English law to convict her of rape by deceit, bc not disclosing this fact is deemed to vitiate consent.

She’s literally going to prison for nothing more than not telling she’s trans to the guy she gave a blowjob to.
