This is a very worthwhile thread.
The hate is real, and, contra the headline, it is not so secret. And the op-eds opposing the Netflix/WB merger have begun. But, as an antitrust lawyer, I think the merger is likely to be pro-competitive and good for consumers. I'll explain why. 1/ www.nytimes.com/2025/12/07/o...

The Supreme Court majority has decided that they are the fact-finders, and the facts are what they want them to be, and quite frankly if District Courts disagree, they can pound sand because they're not the ones in charge.
They're right about the last part. But the damage they're doing is longterm.

Not just left vs right: Most voters think about affordability and material wellbeing, not in ideological terms
Most voters want a party that emphasizes cost of living issues and makes the world a better place. Few Americans think in solidly ideologically terms. "Moderates" are mostly non-ideological.

In my view, Judge Smith's dissent yesterday wasn't just over the top, it was genuinely aberrant.
It was so far outside of what I understand to be the broad range of normal federal judicial conduct that it causes me to question his continuing mental fitness for judging.
