One incredibly confusing and often infuriating part of the system is that having a work permit does not make you “legally here.” Reading between the lines of the story, my first guess is that this person had a final order of removal and yet had been living here on an order of supervision for years.
Legally here on a work permit. Arrested when he went to renew it. Not fighting his deportation. Yet he's been in detention 29 days. No access to a lawyer. Has been given no information about his case. Family inquiries also ignored. ICE only responded when local news requested comment.

For all the complaints about Dems being weak and not fighting, on the thing republicans actually tried to do to defeat democracy that Dems used to fold on, they’ve punched back so hard redistricting will be a win.
NEW: Virginia Dems have unveiled their proposed 10-1 congressional map in response to GOP gerrymanders in other states. It targets 4 Republicans & has 10 Harris seats.

It will be used in 2026 contingent upon an April 21 voter referendum.

At the rate we're going, by the end of this presidential term I wonder if we'll have de facto federal court control of the immigration courts. First a deluge of habeas petitions, and now a (likely) wave of appeals
Among (lots of) other things, this is going to flood the federal courts of appeals with cases in which the BIA might previously have cleaned up the IJ's messes.

When something like this happened in 2004, the circuit courts ... did not respond favorably to the government's positions in those cases.
🚨HOLY CRAP. The Trump admin just took a SLEDGEHAMMER to due process, largely eliminating the Board of Immigration Appeals process and MANDATING DISMISSAL of ALL appeals (which cost $1,000 thanks to OBBBA) filed after tomorrow unless a majority of the BIA votes to hear the case.

Literally just yesterday I remarked to a colleague that this administration is creating a generation of ACCs who don't have a clue how to win cases where the forum isn't stacked massively in their favor. Yeah it must suck to go to real court and be expected to make real arguments with real evidence.
If this is true, I have less than zero sympathy for her.

1. Unlawful entry is a misdemeanor. Unlawful presence is a civil offense.

2. Generally, once your asylum application is pending, you stop accruing unlawful presence.

3. Minors generally can't accrue unlawful presence until they become adults.

My friend lives in Roxbury NJ where ICE is trying to buy a warehouse to convert into a detention center and she says they’re trying to fight it. Apparently many of the people fighting are Trump supporters who voted for deportations but are worried the concentration camp will ruin property values.

Warsh will be whatever Trump wants him to be. That's not the mistake. The mistake is maintaining the absurd charges against Powell, which is causing Tillis to block consideration of a replacement nominee. He could drop it all tomorrow and get his man sooner.
Trump's fed president nomination makes two things very clear:

1.) He literally has no idea how any of this works (he's nominating a hawk again lmao)

2.) He's worried about getting the person through the senate.

This is weak and also confuses the issue. The only deportations* of citizens happening are 1) actual administrative fuck ups (which you can’t meaningfully ban, shit happens) and 2) USC children accompanying their deported noncitizen parents (which you can ban but then you’re doing family separation)

You don’t even need an amendment, you could do this by statute: The president may not sue in his personal capacity while he holds the office. Any federal court that hears such suit must immediately dismiss. Any defendant in state court may remove to federal court.
Apparently another legal/constitutional reform we need now is that presidents shouldn’t be able to sue while they are immune from suit
