"I simply cannot credit [the Trump administration's] declarations to the extent they contradict state and local law enforcement. … DHS' perception of events are simply unreliable."

Chaffin: I think we'd be having a different discussion, and I think it's a much closer call. Points out that most intense unrest in Portland only lasted two hours. Constrasts with what happened in LA - much more violent.

Chaffin: The President referenced Portland as "war-ravaged" and "under siege," but those statements are inaccurate. If facts are inaccurate, they can't be the basis for legal deployment of troops. District Court found that Portland ICE protests were small, less than 30 people, and peaceful.

Wells explains to Perry that, the problem is, "you don't know what you're deferring to in the first instance. And then, you don't know the kind of evidentiary basis for the adequacy of that determination. That, I think, is one of the fundamental problems with the approach that they have taken."
