Folks, any prosecutor with more than an hour's worth of experience can get a grand jury to issue a true bill. Grand juries hear only the evidence the prosecution presents.

With very few exceptions, there is generally only one reason that a prosecutor is unable to obtain an indictment against someone:

They don't want to.

I think this is in some ways the most encouraging thing for me from last night

they really went national full court press to beat Mamdani and they got what they wanted - Republicans showed up, held their noses and voted for Cuomo, the anti-Mamdani coalition worked

they still lost by 9
while the story in Virginia and New Jersey was heavily one of relative turnout, with far more votes than usual coming from liberal areas, this was not the case in New York

Republicans showed up in pretty clearly greater numbers than Democrats, motivated to beat Mamdani

but they didn't

Reading about the 'sandwich assault' and thinking how Soupy Sales was called as witness to testify in a sailor's court martial that pies were harmless.

The 'pie attack' was, much like the sandwich incident, about defiance of authority, not injury.

Says assault requires a “reasonable fear of immediate bodily harm,” and none exists given agent’s long-sleeve shirt, long pants, boots, gloves and ballistic vest that is created to “keep you safe from military rifle fire” and so is “definitely going to keep you safe from a sandwich.”
