One thing we have to recon with as a nation is despite the law, what politicians say, what judges have ruled, and generational affirmations/revaltions—there has never been a moment in U.S. history where people left of center could practice politics or protest without being surveilled.

This is basically the logic conclusion to Graham v. Connor (1989). In which law enforcement actions can only be judge by other law enforcement. It’s why outside of extremely rare circumstances cops can get away with anything. On paper he isn’t “protected by absolute immunity”, but in practice he is.

The "Bundy Militia" spent two days aiming guns at federal agents. Other "militia members" spent over a month doing the same at the Malheur National Wildlife Refuge. Yet conservatives screamed bloody murder when one of them got shot for reaching for his handgun during arrest.

I teach bystander intervention for a living and have taught de-escalation to law enforcement.

Trust me when I say that bottle girls, gas station clerks, strippers, front desk employees at hotels and airports, baristas, etc. have better de-escalation skills than any cop I've ever seen.

Which means consistent resistance by fresh activists in each new city will break them over time.
