States are justifying their bans of transgender health care on a 388-page report called the Cass Review. Supreme Court justices have invoked it.

Today, in @nejm.org, Craig Konnoth and I conclude the report is unsound because it departs from standards in medical law, policy, and practice. 🧵(1/12)

Thrilled that my new piece with @drsinhaesq.bsky.social is out. We review different funding models for research and stress the importance of public funding for two reasons: (1) It can support non-profit-driven research, and (2) It can serve as a bulwark against corporate influence over science.

Indicting political opponents & critics because they are political opponents & critics is terrifying.

It's completely inconsistent with the rule of law & democracy.

It should scare everyone - and (hopefully) will get people to realize that we all need to stand against this.

NEW: @weparmet.bsky.social and me in @amjpublichealth.bsky.social on last Supreme Ct term & impact on health. TLDR: Major concerns about the Court's politicizing health agencies, dashing protections for marginalized groups, and eroding access to justice.

NEW-ish: Louisiana is suing FDA over its 2023 REMS change for mifepristone, which removed the in-person dispensing requirement. That change allowed mail or pharmacy dispensing of mife after significant data showed it was safe and effective. A few things to note about this new lawsuit.

The key thing now is "that the government does not actually have the capacity to successfully negotiate a bespoke 'deal' with every university in the country. All universities have to do now is do nothing—no accepting the compact, no counter-offers, nothing." Great analysis by @fishkin.bsky.social

NEW: It’s… another abortion pill lawsuit against the FDA, this time filed by Louisiana and an individual plaintiff, who argue the FDA should reinstate an in-person dispensing requirement for mifepristone.

And if you guess Alliance Defending Freedom might be involved here, you guessed correctly.

Lawyers are not only risk averse by nature, but they are trained to think about individual clients. This is a bad problem in the kind of complex Prisoner's Dilemma situation we find ourselves.

"We've slid into some form of authoritarianism," says Steven Levitsky, a professor of government at Harvard. "It is relatively mild compared to some others. It is certainly reversible, but we are no longer living in a liberal democracy."

NEW: By a 6–3 vote, the Supreme Court allows the Trump administration to cancel Temporary Protected Status for Venezuelan migrants.

I view today's decision as yet another grave misuse of our emergency docket. This Court should have stayed its hand. Having opted instead to join the fray, the Court plainly mis- judges the irreparable harm and balance-of-the-equities factors by privileging the bald assertion of unconstrained executive power over countless families’ pleas for the sta- bility our Government has promised them. Because, re- spectfully, I cannot abide our repeated, gratuitous, and harmful interference with cases pending in the lower courts while lives hang in the balance, I dissent.
